1. General
Individual Entrepreneur Aliya Abdukarimova ("us", "we", or "our") operates the Power Up app (the "service").
This document informs you of our policies regarding our collection, usage, and storage of personal data and whether such data is or can be shared with third parties. Power Up is committed to transparent and secure data processing and aims to help you understand how we collect, store, use, and protect your information. When using the service as described in the Power Up User Agreement and this Privacy Policy, we act as the data controller.
Unless stated otherwise, the definitions used in this Privacy Policy will have the same meaning as in the Power Up User Agreement. Questions regarding the Privacy Policy and Power Up's processing of your personal information may be sent to info@powerup-go.com.
2. Purpose and use of data
2.1 By using the services provided, Power Up is processing your personal information for the purposes stated in the Power Up User Agreement, this Privacy Policy, and in compliance with applicable laws and regulations.
2.2 Power Up processes your data for the following purposes:
a) Analyses to develop the services regarding functionality, security, and methods. The legal basis for this processing is our legitimate interest in improving our services and increasing our knowledge of the market and users.
b) Entering into or carrying out a contract with you per our User Agreement and any other contractual obligations between Power Up and you as a user of our services.
c) Providing you with customized information regarding our services based on specific data factors such as location, preferences, and behavior patterns. The legal basis for this processing is the contractual necessity of providing you with the services.
If you do not comply with Power Up’s processing of your data according to clause 2.2, we must be notified according to Article 3 below. Please note that Power Up cannot exclude any processing of data as stated above since the services cannot be provided unless you agree to the data processing outlined in clause 2. If you revoke your consent, it does not affect the legality of data handling prior to the revocation.
2.3 For the purposes stated in section 2.2, we may process your name, phone number, email address, location data, and other information provided to Power Up. This processing is necessary to provide the service.
Power Up does not process any special category data as defined by GDPR.
Power Up does not collect any payment information as it is sent directly to our payment provider.
2.4 Power Up may provide personal data to third parties that provide services to us, such as IT service providers. If required by law or authority, we will provide data to authorities. If Power Up transfers any information outside the EU/EEA, it will only be carried out after sufficient protection measures are taken, such as entering agreements regarding transfer and data processing with the recipient.
2.5 Power Up may also process your data to:
a) comply with laws, regulations, or court orders;
b) apply the Power Up User Agreement; or
c) protect Power Up's or any partner's rights, such as in a court case.
3. Rights and contact
3.1 Power Up is the data controller responsible for processing your data in accordance with applicable laws. Data is only stored as long as necessary to fulfill the purposes for which it was collected. If your account is canceled, we will delete all saved data, except for data required by law or to protect our legal interests.
3.2 Power Up strives to keep your data accurate and up to date. As a user, you may request access to, update, modify, limit processing, or delete data related to your account. You also have the right to object to our data processing and the right to data portability. Some changes can be made directly by you through the Power Up App.
To exercise any of your rights, you may contact Power Up at info@powerup-go.com. Repetitive or unreasonable requests may incur a fee. We generally respond within one month.
3.3 If you find that your personal information is incorrect or not handled according to applicable laws, please contact Power Up at info@powerup-go.com. Power Up will promptly correct, block, or delete inaccurate personal data or data not processed according to the law.
4. Security
The technology used by Power Up, together with this Privacy Policy, is designed to protect your data from unauthorized access and use. These measures may be updated as new technology becomes available.
5. Links to other websites
The Power Up app may contain links to third-party websites. Power Up is not responsible for the content or data processing of such websites.
6. Changes in the Privacy Policy
Power Up reserves the right to change this Privacy Policy without notice by publishing a new version on the website. However, in the case of significant changes, we will also notify you by sending an email with information about the changes.
